Malinda Rice, 39, of Rt. 2, Box 8A, Proctor, was sentenced March 22 to one to 15 years in the West Virginia Penitentiary for Women. However, the execution of this sentence was suspended and Rice will instead serve two years of supervised probation under Chief Probation Officer John D. Lantz.
On Feb. 6, Rice pleaded guilty in Wetzel County Circuit Court to the felony offense of delivery of oxycodone, which is to have occurred on or about June 12, 2012. A pre-sentencing report was then filed in the case by Lantz.
In another matter, Samuel Arthur Wade, 33, of Route 1, Box 69, Folsom, is set to return to court May 2, 1:30 p.m, as a transcript that is necessary for his case was still not complete.
Counts one, four, and seven of Wade's indictment state that at some point between Nov. 1 and Dec. 26, 2010, Wade allegedly committed the felony offense of sexual assault in the second degree. Counts two, five, and eight charge Wade with the felony offense of incest. Counts three and six charge Wade with sexual abuse by a custodian.
Kimberly Dawn Parsons, 21, of 248 Woodland Knls 28, Moundsville, W.Va., will return to court April 19, 10 a.m., for a plea.
Parsons received a one-count indictment from the September grand jury stating that on or about June 15, 2012, she committed the felony offense of unlawful assault in that she unlawfully caused bodily injury to a woman by striking her with a pipe in New Martinsville.
A transcript order was not prepared for Edward K. Hornbeck, 36, of 187 North State Route 2, Apt. D101, New Martinsville; therefore, he did not appear for his hearing. The hearing was thus rescheduled for March 28, 1:30 p.m.
Hornbeck entered a plea of innocence on Oct. 19 to three counts of conspiracy to deliver and three counts of delivery of oxycodone. These offenses are to have allegedly occurred on or about March 21, March 28, and May 23.
The court is still awaiting the outcome of Marshall County Circuit Court hearings involving Dillon O. Haley, 21, of 413 Edgeview Terrace, New Martinsville, before they proceed on with his Wetzel County Circuit Court probation revocation matters. Therefore, Haley will return to court April 1, 1:30 p.m.
On May 25, Haley entered a plea of guilty to petit larceny. Haley was sentenced to confinement in jail for six months. However, the execution of that sentence was suspended and he was placed on probation for two years.
Drug test results on July 7 confirmed that Haley had tested positive for oxycodone. Furthermore, on July 5, Haley was cited for two traffic violations in Washington, Pa., driving on a suspended license and driving a "defective" vehicle. Finally, Haley had two more criminal charges from Marshall County, forgery and uttering.
A possible plea is in the works for cases involving Natasha Lynn Tedrow, 22, of 447B Martin Ave., New Martinsville; she will return to court April 1, 1:30 p.m.
Tedrow's indictment states that on or about July 11, she conspired with Joshua E. Burch, Jason Scott Dalrymple, and an unknown white male to deliver Subutex.
Both Justin Kyle Smith, 23, of 524 Martin Ave., New Martinsville, and Paul James Ellenwood, 18, of 187 North State Route 2, Apt. D104, New Martinsville, are also set to appear again in court April 1, 1:30 p.m.
Smith's one-count indictment states that on or about Aug. 20, Smith delivered oxycodone.
From the September 2012 grand jury, Ellenwood received a two-count indictment charging him with conspiracy to deliver oxycodone, as well as delivery of oxycodone. These offenses allege that on or about June 18, Ellenwood conspired with another to deliver oxycodone.
Justin Matthew Martie, 25, of 454 N. Main Street, New Martinsville, waived his right to a speedy trial for this current term of court. He will appear again May 15, 10 a.m.
From the September 2012 grand jury, Martie received a two-count indictment. Count one states that on or about June 21, 2008, Martie feloniously stole a 2002 Suzuki Ozark ATV which belonged to David L. Smith. Count two of the indictment states that between July 5 and 14, 2008, Martie committed the felony offense of third degree arson in that he set fire to and burned a 2002 Suzuki Ozark ATV, which had a value of more than $500.
Gary L. Wade, 27, of HC 62, Box BB, Pine Grove, will appear in court again April 1, 1:30 p.m.
Count one of Wade's three-count indictment charges him with delivery of oxycodon. Count two and three charge Wade with conspiracy to deliver oxycodone and delivery of oxycodone.
