W.Va. woman to be retried in husband's death

WEBSTER SPRINGS, W.Va. (AP) — A Webster County woman is scheduled to be retried on charges of killing her husband in 2009.

Media outlets report that Julia Surbaugh's new trial is set to begin Tuesday in Webster County Circuit Court.

A Webster County jury convicted Surbaugh of first-degree murder in May 2010. She was sentenced to life in prison with no chance for parole.

The West Virginia Supreme Court overturned the conviction in November 2012 and sent the case back to circuit court for a new trial. The justices ruled that the lower court judge didn't give a proper jury instruction on evidence of good character.

Court records show that Surbaugh's husband, Michael Surbaugh, was shot three times in the face on Aug. 6, 2009.
