Defendants Plead Innocent

Several matters were heard before the Honorable Judge Mark A. Karl March 10 in Wetzel County Circuit Court.

Innocent pleas were entered on behalf of Cynthia Louise Henries, aka Cindy Postlethwait, 43, of 28 Rose St. Lot 63N, New Martinsville. Defense attorney Brent Clyburn stated that he had received part of the discovery in the matter but was going to submit a formal request. He asked that the matter be passed until April 3, 9:15 a.m.

Henries was handed down a four-count indictment by the January 2015 grand jury, charging her with various drug-related offenses. The indictment alleges that all of these offenses occurred on or about April 4, 2014. Count one, conspiracy to possess a controlled substance (synthetic cannabinoid) with intent to deliver, alleges that Henries conspired with Christopher Lee Leek to possess synthetic cannabinoid with the intent to deliver. Count two alleges that Henries committed possession of a controlled substance (synthetic cannabinoid) with intent to deliver.

Count three charges Henries with conspiracy to possess a controlled substance (bath salts) with intent to deliver in that Henries conspired with Christopher Lee Leek to possess bath salts with the intent to deliver. Count four charges possession of a controlled substance (bath salts) with intent to deliver.

In another matter, Karl rejected a plea from Christopher Lee Leek, 27, of 33 Ross St. New Martinsville, as Karl stated that Leek had not completed the answers on his plea information sheet. Specifically, Karl mentioned that Leek had answered “No,” to the question asking if the plea was in his best interest.

Leek was handed down four counts by the grand jury, charging him with conspiracy to possess a controlled substance (synthetic cannabinoid) with intent to deliver, possession of a controlled substance (synthetic cannabinoid) with intent to deliver, conspiracy to possess a controlled substance (bath salts) with intent to deliver, and possession of a controlled substance (bath salts) with intent to deliver. These offenses all allegedly occurred on or about April 4, 2014, counts one and three allegedly occurring with Henries.

In a case involving Jeremy Seth Derby, 33, of 812 North 7th Ave., Paden City, was continued until April 3, 10:15 a.m. It was noted that there were several motions to be heard. Also, Derby agreed to waive his speedy trial rights and the matter will be continued until the May 2015 term of court.

Derby received an eight-count indictment from the January 2015 Grand Jury charging him with various offenses of a sexual nature. Derby was handed down two charges of sexual assault in the second degree, four charges of sexual abuse by a custodian and two charges of sexual abuse in the first degree.

All of these alleged offenses took place between Aug. 1, 2010, and Aug. 31, 2011. The alleged victim in the cases was under the age of 16 at the time the offenses occurred. The indictment alleges that Derby had inappropriate contact with a child who would have been under his care, custody, or control.

In another matter, the case involving David Kellar, 51, formerly of HC 60 Box 93, Apt. 26, Pine Grove, has been passed until April 3, 9:15 a.m.

The court had received the results back of a competency evaluation and it was noted that Kellar is criminally responsible and competent to stand trial. It also was noted that there had been no resolutions in the case.

Kellar has been given three counts of sexual assault in the third degree and three counts of sexual abuse by a custodian. These offenses all allegedly occurred between Jan. 1, 2013, and Dec. 31, 2013, with the female victim being under the age of 16.
