Frye Pleads To Possession

Tina Frye, 31, of 1716 Elizabeth Street, Belpre, Ohio, pleaded guilty Friday in Wetzel County Circuit Court to the lesser included offense (possession) of counts one, three, and five of her five-count indictment: possession of a controlled substance (marijuana) with intent to deliver; possession of a controlled substance (methylphenidate), and possession of a controlled narcotic substance (morphine) with intent to deliver. Frye’s other charges, possession of a controlled substance (alprazolam) with intent to deliver and possession of a controlled narcotic substance (hydrocodone) with intent to deliver, were dismissed as she had produced a prescription for them.

Frye was sentenced to 90 days for each of the offenses she pleaded to; these 90 days sentences were to run concurrent to one another, as well as concurrent to a battery charge pending in magistrate court. Frye had already served 99 days in prison, so she was able to be released that day.

Prosecuting Attorney Timothy Haught stated that the day the offenses occurred New Martinsville Police Department responded to a call and located a purse belonging to Frye. Haught stated that the contents of the purse were the drugs set forth in the indictment.

When asked what made her guilty of the crime, Frye stated that she guessed it was because the drugs were in her bookbag.

Per the terms of the plea agreement, Frye’s other counts of the indictment, two and four, were dismissed.

On his Wetzel County Prosecuting Attorney’s Office Facebook page, Haught further stated that Frye is on federal probation and faces possible revocation and imposition of her original federal sentence. He stated that all money or property seized during Frye’s arrest was forfeited to the NMPD. He also expressed gratitude to Patrolman Mike Owens for a “job well done.”
