Three Plead To Charges

Andrew William Richard, 25, of 28 Rose Street, Lot 80, New Martinsville, pleaded guilty March 5 to his one-count felony indictment of entry of a building other than a dwelling. Additionally, Richard also pleaded to a one count information of felony daytime burglary. The indictment was handed down by the January 2014 grand jury.

Richard was sentenced to one to 10 years in the West Virginia Penitentiary for Men for each offense with credit for time served. These sentences are to run concurrently. Richard is also ordered to pay outstanding restitution. The state agreed not to file a recidivist against Richard.

Richard’s felony charge stems from an incident that occurred Nov. 17 when Richard allegedly entered Tractor Farm Supply in the New Martinsville Plaza by scaling the fence. Richard confessed that he was drunk and on drugs at the time of this incident. He stated he was on Xanax, which he purchased at $4 a piece off the street.

Richard’s charge of daytime burglary stems from an offense committed where he entered a Wetzel County residence and stole gold, which he then took to a pawn shop in Ohio.

Michael Anthony Rose, 20, of Shinnston, pleaded guilty to one felony count of destruction of property. For this offense, he was sentenced to one year in prison, with credit for 205 days already served.

This offense stemmed from a situation that occurred when Rose and other individuals rented a brand new Chevy Silverado truck, which they then entered in a mud bog, capturing the “beat down” on YouTube. After destroying the truck, the individuals took it to Five Points in Wetzel County where they shoved it over a hill. Besides the prison sentence, Rose was ordered to pay one quarter of restitution. Prosecuting Attorney Timothy Haught stated the total amount in damages was approximately $39,000.

In another matter, Chester Gene Tippins, 44, of RR 2 Box 71, New Martinsville, pleaded guilty to the lesser included offense of one misdemeanor count of second offense domestic battery. For this offense, Tippins was sentenced to 12 months in the Northern Regional Jail. Tippins is also to have no further contact with the victim in the case.

Originally, Tippins was charged by the January 2014 grand jury with two counts of sexual abuse in first degree and one count of third offense domestic battery. Those counts were dismissed as part of his plea bargain.
