Cynthia Smith, 25, of 618 North Fourth Avenue, Paden City, appeared in Wetzel County Circuit Court Dec. 6 relative to a petition to revoke her probation.

According to the petition, Smith had been administered a random drug screening which tested positive for marijuana.

The state recommended that Smith be considered for drug court as the program was not available when she was released on a motion for reduction in sentence in June 2012.

The Honorable Judge David W. Hummel ordered that Smith would be assessed for purposes of drug court and the matter would be held for now.

Smith pleaded guilty on May 3 to one count of conspiracy to deliver hydrocodone, a Schedule III controlled substance. She was sentenced to one to five years in prison, but was given credit for 145 days. Smith successfully served six months and 10 days in prison and had no write ups. Thus, Judge Mark A. Karl had granted a reduction in sentence and placed Smith on two years of probation.

In another matter, Summer Sellers Riley, 31, also appeared in court on a petition submitted to revoke her probation, as the state alleges Riley has recently been at the New Martinsville Villas. Per the terms of a plea agreement Riley had entered into on Feb. 7, she was forbidden from being at that apartment complex.

It was also noted that Chief Probation Officer John D. Lantz had concerns about Riley being honest with him concerning her place of residence. Therefore, Riley was ordered to state to the court where she was living. She stated she was currently residing at her boyfriend’s mother’s residence in the Silver Hill area.

Riley will return to court Dec. 19, 12:15 p.m., concerning her probation violation.

On Feb. 7, Riley was sentenced to three years of probation for drug-related offenses.
