Charles Robert Wells

On Oct. 7, Charles Robert Wells, 47, of P.O. Box 53, Proctor, was sentenced to one to five years in the West Virginia Penitentiary for Men for failure to appear on felony bail.

He was given credit for time served and remanded to finish his sentence. He may file a Rule 35 motion for reduction of sentence after successfully completing one year of his sentence. Charges of domestic battery were dismissed.

On Sept. 11, Wells failed to appear in court; thus, a capias was issued for his arrest. Prosecuting Attorney Timothy Haught had stated at the time that Wells had been convicted in Sistersville’s city court of fighting in public and disorderly conduct. “This is the second time I’ve filed a motion to revoke his bond,” Haught stated at the time.

At his next court date, Wells lamented that he had not known he had court. His attorney in regards to case 12-F-20, David C. White, urged him not to speak. Judge Mark A. Karl had given Wells a stern warning at this time, telling him to pay attention to his attorneys (White and Gardner, who was representing Wells in case 12-F-91), as he could have been facing life in prison.

From the January 2012 grand jury, Wells received a one-count felony indictment for third-offense domestic battery.

Additionally, from the September 2012 grand jury, Wells was charged with third or subsequent offense domestic battery, as well as battery.
