Karl Continues Cases
Several defendants appeared before Judge Mark A. Karl Sept. 11 for the court’s docket day.
Charles Michael Young, 52, and Mary Evelyn Young, 51, both of Route 1, Box 31A, New Martinsville, will both return to court on Sept. 26, 1:15 p.m. Attorney Kevin Neiswonger stated that the state had submitted additional pieces of evidence related to the case to the state crime lab. However, the results had not been determined yet. Regardless, Neiswonger stated a voluntariness hearing would be necessary, regarding statements the Youngs had made to West Virginia State Trooper C.J. Lantz.
Both are charged with intentionally and feloniously misappropriated the assets of a man over the age of 65 and feloniously forging the attestation of a notary public. Additionally, Mary Evelyn Young’s third count in her indictment charges her with the offense of uttering.
In another matter, Nicky Nicole Mavety, 24, of PO Box 97, New Martinsville, will enter into a plea agreement on Sept. 26. Neiswonger informed the court that his client was indicted Sept. 10. However, an agreement had been made regarding one of Mavety’s previous indictments that would dispose of this new indictment.
Mavety received a two-count indictment from the September 2012 grand jury charging her with entry of a building other than a dwelling and petit larceny. Count one alleges that on or about July 14, she entered WalMart Store #2684 in New Martinsville with the intent to commit a larceny. Count two alleges that she stole goods with a cumulative value of less than $1,000 from WalMart.
A separate indictment charges Mavety with conspiracy to deliver oxycodone, along with delivery of oxycodone.
The case involving Larry Virgil Watson III, 21, of HC 61, Box 95B, Littleton, will go to trial on Dec. 16, 9 a.m., as Attorney David C. White informed the court that an agreement was not reached.
