Mindy Murphy Omear, 33, of 730 Highland Avenue, New Martinsville, was sentenced Monday to one to five years in the West Virginia Penitentiary for Women.

Omear pleaded guilty April 17 in Wetzel County Circuit Court to conspiracy to deliver oxycodone, a Schedule II narcotic substance, but a pre-sentencing report was prepared for sentencing.

When asked if counsel had any remarks before the verdict was read, Defense Attorney Shane Mallet responded that his client was ready to accept the sentence but requested three days to get her affairs in order. He added that Omear had been on time for all of her hearings.

Prosecuting Attorney Timothy Haught stated that the prison sentence was what the state was recommending, due to Omear’s lengthy criminal record, which involves previous jail time, escape from home confinement, grand theft auto, submitting false information to police, DUI, and more. Furthermore, Omear’s co-defendant in the case at hand has been sentenced to two to 10 years in prison; also, several of Omear’s charges had been dropped in the current case, in conjunction with the plea agreement.

Haught stated that based on Omear’s previous criminal history, along with her involvement with Ronald A. Dunham, the co-defendant, he did not believe she would be a good candidate for anything other than prison time.

Karl appeared to agree, and ordered that Omear report to the Wetzel County Sheriff’s Department on June 21, noon.

On Sept. 25, 2012, Omear was handed a six-count indictment by the September 2012 grand jury.

Counts one and two of Omear’s indictment, conspiracy to deliver oxycodone and delivery of oxycodone, stated that on July 11, she allegedly conspired with Ronald L. Dunham, also known as “Buck”, to deliver oxycodone.

Counts three and four, conspiracy to deliver oxycodone and delivery of oxycodone, stated that on July 12 Omear allegedly conspired with Dunham to deliver oxycodone and delivery of oxycodone.

Counts five and six, conspiracy to deliver oxycodone and delivery of oxycodone, stated that Omear allegedly conspired with Dunham and Daniel Ray Jones, also known as “Little D,” to deliver oxycodone. Both of these offenses are to have occurred on or about July 19.
