Brody Ostrander

Brody Ostrander, 19, of Proctor, appeared with his attorney, Herman Lantz, before Tyler County Magistrate Michael K. Griffin on Aug. 31 for a pre-trial hearing.

Ostrander is charged in Tyler County under three separate complaints and warrants alleging indecent exposure. Lantz filed a motion for discovery earlier in the week.

Tyler County Prosecuting attorney D. Luke Furbee filed the state’s initial responses to the discovery motion during the hearing. In criminal cases, the process known as “discovery” is not triggered until a defendant requests discovery.

Lantz made another motion to have the cases rescheduled for another pre-trial hearing in order to give him time to review the discovery with Ostrander. Magistrate Griffin granted the request.

Ostrander was charged following a series of incidents in spring 2010 in which he allegedly exposed himself to traffic along state Route 2 and other areas of Marshall County. He was also charged with two counts of indecent exposure in New Martinsville on July 16 in which the witnesses included two children.
