Kidnapping Incident Could Result In A Life Sentence

By Staff | Aug 31, 2011

A Belleville, W.Va., man faces a life sentence after allegedly kidnapping a local woman.

According to reports, Brandon Robert Harvey, 25, of 6326 Lee Creek Road, took a young woman from New Martinsville against her will after agreeing to meet him the morning of Aug. 20. A warrant was promptly issued for Harvey’s arrest. Fortunately, in Wood County the victim got away from Harvey and called 911. He was arrested and charged with kidnapping, an offense which carries a life sentence in the state penitentiary if convicted.

Harvey was arraigned in Wood County Magistrate Court later that morning and was committed to jail without bond. He then appeared before Magistrate Judith Goontz in Wetzel County on Monday alongside public defender Jeremiah Gardner.

During that hearing Harvey filed for a motion to set bond, which Goontz denied, as Magistrate Court does not have jurisdiction to try a lifetime offense. According to Goontz, only Circuit Court can set bond in such a matter.

Presently being held in the Northern Regional Jail, Harvey is set to return to Wetzel County Magistrate Court this Friday at 11 a.m.
