Judge Hummel Arraigns Several New Indictees

Judge David W. Hummel Jr. heard several drug possession arraignments Sept. 29 in Wetzel County Circuit Court.

Evelyn D. Bowen, 42, of Post Office Box 42, Folsom, pleaded innocent to a one-count felony indictment of possession of a controlled substance (marijuana) with intent to deliver. It is alleged to have occurred on April 2. Her return date is set for Oct. 22 at 1 p.m. Her surety bond is maintained at $15,000.

Howard P. Mackey Jr., 40, of Post Office Box 195, Hundred, pleaded innocent to the felony offense of possession of a controlled substance (marijuana) with the intent to deliver to have allegedly occurred on or about July 21. Mackey is to return to court Dec. 4 at 9:15 a.m. His $10,000 surety bond as set in Magistrate Court was continued.

Linda Fordyce, 51, of P.O Box 195, Hundred,. pleaded innocent to felony possession of a controlled substance (marijuana) with intent to deliver that allegedly occurred on July 21. Her return date is set for Dec. 4 at 9 a.m.

Stefanie Leann Lucas, 24, of 128 South First Ave., Paden City, pleaded innocent to a two-count indictment. The first count is for felony possession of a controlled substance (marijuana) with intent to deliver to have allegedly occurred on Jan. 13. The other indictment is felony possession of a controlled substance (heroin) with intent to deliver, also to have allegedly occurred on Jan. 13. Her return date is set for Dec. 4 at 9:15 a.m. Her cash bond of $20,000 will continue.

Tyler Joseph Steed, 20, of 111 South Main St., Belle Valley, Ohio, claimed he was financially unable to attain a lawyer, and Hummel gave him the proper paperwork to file for eligibility for a public attorney. Steed must have a lawyer or be prepared to represent himself by his hearing on Oct. 22 at 1:30 p.m. His $10,000 surety bond will continue.

Steed is charged with a one-count felony indictment of possession of a controlled substance (hydrocodone) with intent to deliver that allegedly occurred on Oct. 12, 2008.

Kathleen A. Whitehair, 45, of HC 62 Box 67-A, Burton, pleaded innocent to a one-count indictment of felony delivery of a controlled substance (cocaine) that allegedly occurred on April 26. A mandatory status conference was set for Nov. 2 at 8:30 a.m. Her bond was set at $5,000 personal recognizance bond.

Hummel appointed Patricia Kurelac to represent George D. Burch, 66, of 302 West Main St., Paden City, who is facing a three-count indictment: one count, failure to update sex offender registry information, failing or refusing to report his move to a new address; count two, failure to register as a sex offender in the month of his birth to the State Police detachment to have allegedly occurred between the dates of Sept. 1 and 30, 2007; count three, failure to register as a sex offender in the month of his birth to the State Police detachment to have allegedly occurred between the dates of Sept. 1 and 30, 2008.

Burch had previously qualified for a court appointed attorney and he told Hummel his financial situation had only gotten worse since then. He is to get in contact Kurelac and they will address the matter in court Oct. 22 at 1 p.m.

Michael W. Winland, of 48013 State Route 556, Beallsville, pleaded innocent to two separate one-count indictments. The first, felony obtaining money by false pretenses to have allegedly occurred between Nov. 7 and 21, 2007, by willfully, unlawfully, knowingly, and feloniously obtaining timber having a value of more than $1,000 from Jacob P. Morgan by falsely representing that he would harvest and sell the timber and pay a portion of the proceeds to Morgan. The other indictment is also felony obtaining money by false pretenses to have allegedly occurred between Aug. 8 and Dec. 31, 2008.
