Grand Jury Returns 26 True Bills

On Sept. 15 Judge David W. Hummel Jr., presiding in the Wetzel County Circuit Court, announced the 16 new indictments as found by the grand jury Sept. 8. These indictments include 26 true bills.

Jack D. Keys, 50, of Post Office Box 764, New Martinsville, is charged with a four count indictment. Count one is felony fleeing from an officer while driving under the influence. Count two is misdemeanor second-offense driving under the influence of alcohol. He was previously convicted for the offense of DUI in Magistrate Court on March 15, 2004. Count three and four are identical, felony child abuse by creating a risk of serious bodily injury or death by fleeing from a law enforcement officer in a motor vehicle while driving under the influence of alcohol. All four counts were allegedly to have occurred on July 31 in Wetzel County. The court noted there was no return on the summons for him to appear.

Rebecca Dawn Beltran, 20, of RR 1 Box 87 Carmichael, Glen Easton, W.Va., was charged with a two-count indictment. Count one is a felony offense of entry of a building other than a dwelling to have allegedly occurred between July 16 and 24, 2008, in which she entered a building belonging to Carl Nelson on Commercial St., New Martinsville, with the intent to commit a larceny. Count two is felony grand larceny to have allegedly occurred between the dates of July 16 and 24, 2008, with the value of $1,000 or more of paintball guns and equipment that belonged to Nelson. It was noted in the courtroom she has not been served yet. She is to appear in court on Sept. 29.

Daniel Todd Hunter, 45, of HC 61 Box 99, Littleton, was charged with a two count indictment. Count one is a felony offense of burglary that allegedly occurred on September 2008 in which Hunter broke into the residence of Peter Parker located near Littleton. Count two is grand larceny of $1,000 of goods belonging to Peter Parker. He is scheduled to appear in court again on Sept. 29 at 10 a.m.

Nickolas Brady Matthews, 27, of 128 South First Ave., Paden City, is charged with two counts. Count one is felony possession of a controlled substance (marijuana) with intent to deliver and the other count of possession of a controlled substance (heroin) with intent to deliver. Both to have allegedly occurred on Jan. 13.

Prosecutor Tim Haught stated to the courtroom that Matthews is serving time in Ohio on other charges. Hummel noted this and allowed time for security officers to transport Matthews to the Wetzel County courtroom for his next scheduled appearance on Oct. 2 at 10 a.m.

Howard P. Mackey Jr, 40, of Post Office Box 195, Hundred, is charged with the felony offense of possession of a controlled substance (marijuana) with the intent to deliver to have allegedly occurred on or about July 21. His next scheduled appearance will be Sept. 29.

Stefanie Leann Lucas, 24, of 128 South First Ave., Paden City, is charged with a two-count indictment. The first count is for felony possession of a controlled substance (marijuana) with intent to deliver to have allegedly occurred on Jan. 13. The other indictment is felony possession of a controlled substance (heroin) with intent to deliver, also to have allegedly occurred on Jan. 13. She is to report back in court on Sept. 29 at 10 a.m.

Evelyn D. Bowen, 42, of Post Office Box 42, Folsom, has a one count felony indictment of possession of a controlled substance (marijuana) with intent to deliver to have allegedly occurred on April 2. Her attorney, Roger Weese, was not present. She will return to court on Sept. 29 at 10 a.m.

A sealed indictment was opened by Judge Hummel which contained a one count indictment against Linda Fordyce, 51, of P.O Box 195, Hundred. She is charged with felony possession of a controlled substance (marijuana) with intent to deliver that allegedly occurred on July 21. She is to report to court on Sept. 29 at 10 a.m.

In other indictments, Allen Richard Larrimore, 50, of HC 79, Box 5 EE, Jacksonburg, is charged with one count of felony third-offense domestic battery to have allegedly occurred on July 22. He was previously convicted of domestic battery in Wetzel County Magistrate Court on March 26, 2007, and on March 25, 2009. He was represented by his attorney, Jeremiah Gardner, and pleaded not guilty. His trial date is set for Oct. 30 at 9 a.m. A status hearing will be held on Oct. 22 at 1:30 p.m.

Kathleen A. Whitehair, 45, of HC 62 Box 67-A, Burton, has a one-count indictment of felony delivery of a controlled substance (cocaine) that allegedly occurred on April 26, 2009. Hummel appointed a lawyer on her behalf. Her next court date is Sept. 29 at 10 a.m.

Tyler Joseph Steed, 20, of 111 South Main St., Belle Valley, Ohio, is charged with a one-count felony indictment of possession of a controlled substance (hydrocodone) with intent to deliver that allegedly occurred on Oct. 12, 2008. A capias warrant was issued against him by Hummel.

Jason L. Morgan, 34, of 37436 Sunset Trailer Court, Sardis, received a two count indictments: count one, felony fleeing from an officer while driving under the influence; and count two, driving under the influence, both to have allegedly occurred on Jan. 19. Hummel issued a capias warrant for him.

Michael W. Winland, of 48013 State Route 556, Beallsville, is charged with two separate one count indictments. The first, felony obtaining money by false pretenses to have allegedly occurred between Nov. 7 and 21, 2007, by willfully, unlawfully, knowingly, and feloniously obtain timber having a value of more than $1,000 from Jacob P. Morgan by falsely representing that he would harvest and sell the timber and pay a portion of the proceeds to Morgan.

The other indictment is also felony obtaining money by false pretenses to have allegedly occurred between Aug. 8 and Dec. 31, 2008. The scenario is the same as the first indictment, except the victim is Don VanDyke. Winland’s next court appearance is scheduled for Sept. 29 at 9 a.m.

George D. Burch, 66, of 302 West Main St., Paden City, received a three-count indictment: one count, failure to update sex offender registry information, failing or refusing to report his move to a new address; count two, failure to register as a sex offender in the month of his birth to the State Police detachment to have allegedly occurred between the dates of Sept. 1 and 30, 2007; count three, failure to register as a sex offender in the month of his birth to the State Police detachment to have allegedly occurred between the dates of Sept. 1 and 30, 2008.

Prosecutor Tim Haught explained to the courtroom that Burch was not present in the courtroom due to his illness and he is on oxygen. He further explained that Burch has previously been in the hospital. His next scheduled court appearance will be on Sept. 29 at 10 a.m.

Cecil Dewayne Ingold, 52, of 101 Evans Ave., Apt. 21, New Matamoras, received a one-count indictment for failure to appear on a felony bail to have allegedly occurred on Jan. 14. He is presently serving time at the Northern Regional Jail for possession of a controlled substance (marijuana) with intent to deliver.
