Riley Gets Three Years Probation

Summer Sellers Riley, 28, of 187 North State Route 2, Villa Apartments, New Martinsville, will serve three years of probation for drug-related offenses.

In Wetzel County Circuit Court on Feb. 7, Judge Mark A. Karl sentenced Riley to confinement in the West Virginia Penitentiary for Women for a period of one to 15 years. Judge Karl then acknowledged that Riley has had over four months of incarceration and then suspended the execution of her prison sentence.

“You have two children to take care of. You have a chance to turn this around,” Karl stated. He ordered that Riley attend drug counseling and find employment within the first six months of her probation. “There’s a lack of people looking for work, not a lack of employment,” the judge stated.

Attorney Kevin Neiswonger stated that his client has “adamantly maintained that she did not deliver pills,” adding that when the confidential informant approached Riley and asked her if she had any pills for sale, she “said she knew somebody that had them, and took them to the CI.”

Neiswonger added that his client has served four months, stating, “I think that’s the standing offer in all the other cases right now, and I think probation would be appropriate.”

Neiswonger also approached the bench to advise the court of “another matter.”

The prosecution had stood by their recommendation that Riley serve the one to 15 years.

Riley had pleaded guilty Dec. 17 to count two of her indictment in case 12-F-126, delivery of oxycodone.

Per the term of Riley’s plea agreement, the remaining count in case 12-F-126, conspiracy to deliver oxycodone, was dismissed. This indictment was handed down to Riley from the September 2012 grand jury.

Riley had also been handed a one-count indictment from the January 2012 grand jury, which charged her with felony delivery of oxycodone. Per the terms of Monday’s plea, this case, 12-F-37, was also dismissed. Riley confessed to delivering oxycodone on Aug. 27 of this year
