Gray Receives 10-25 Years for Sexual Abuse

In Wetzel County Circuit Court on Friday, Lonnie David Gray, 65, of HC 60, Box 70, New Martinsville, was sentenced to 10-25 years in the West Virginia Penitentiary for Men for two counts each of sexual abuse in the first degree and sexual abuse by a custodian.

Gray pleaded guilty to counts 13, 15, 16, and 18, of his 18-count indictment. These charges consisted of two counts of sexual abuse in the first degree (13, 16) and two counts of sexual abuse by a custodian (15, 18). Counts 13 and 16 each carried a recommended five to 25 years in prison, along with a $1,000 fine for each charge. Counts 15 and 18 each carried a 10-20 year prison sentence. Per the terms of the agreement, the further recommendation was that these sentences be served concurrently. Therefore, Gray will serve a sentence of 10-25 years. Upon his release, he will be supervised for 20 years, plus he would be required to register as a sex offender. He is to have no contact with the minor female victim, pay for the cost of her counseling, and pay the cost of prosecution.

The state agreed not to file a recidivist information and dismissed the remaining counts.

Gray admitted to committing these acts, stating "I touched her, sexually." When asked if he had anything to say to the court, Gray had said "I'm sorry for what I've done."

It was requested by the defense that Gray have a week to get his affairs in order before turning himself in. Special Prosecuting Attorney Carl "Worthy" Paul adamantly opposed such a request, stating that Gray had plenty of time prior to his plea to have gotten his affairs in order. Gardner stated that Gray had wanted time to prepare a will; Paul responded, "He can prepare a will from prison."

Karl took a while to ponder his decision and decided to permit Gray to remain on bond until Jan. 22, noon. At this time, Gray was to turn himself in to the Wetzel County Sheriff's Office.

Gray had been indicted on eight counts of sexual abuse in the first degree, eight counts of incest, and two counts of sexual abuse by a custodian.

Each count of sexual abuse in the first degree, (counts one, three, five, seven, nine, 11, 13, 16) allegedly occurred at a separate time and date from each other charge of sexual abuse in the first degree. They state that Gray allegedly subjected a person, who is 11 years old or less, to sexual contact.

Likewise, counts two, four, six, eight, 10, 12, 14, and 17 of incest are stated to have occurred at a time and date separate from each other charge of incest in the indictment.

The indictment further states that Gray allegedly committed the felony offense of sexual abuse by a custodian in that he, being the custodian of a child under his care, engaged in or attempted to engage in sexual contact with the child. Counts 15 and 18 of sexual abuse by a custodian are also to have occurred at dates and times separate from each other.
