DEP, Justice make tentative deal on hazardous dam

BECKLEY, W.Va. (AP) — Billionaire Jim Justice and the Department of Environmental Protection have a tentative deal to improve a private dam that regulators say presents a potentially deadly flooding hazard to drivers.

DEP Secretary Randy Huffman tells the Beckley Register-Herald (http://bit.ly/165T7Ri) it should satisfy both sides.

Neither offered details about plans for the Mallard Lake dam at The Resort at Glade Springs.

Huffman also says Justice agreed to a risk-management plan for the road and will submit a plan in about two months.

Justice tells the newspaper the solution is reasonable but didn't say how much it will cost him or whether he'll pass that cost on.

He'd previously threatened to transfer responsibility for the dam and road to a property owners' association.

Compliance plans for the dam were due in April 2012.
